In early 2022, the Drug Enforcement Agency (DEA) sent a reply letter to an inquiry by Vicente Sederberg’s Shane Pennington, clarifying that cannabis seeds—which contain less than 0.3 percent THC on a dry weight basis—are in fact legal under the 2018 Farm Bill.
The news was considered a surprising yet tepid win for the industry, where licensed growers and breeders have faced difficulties selling and acquiring genetics under stringent regulations in some states, and a “don’t ask, don’t tell” policy in others, while selling seeds to the public for home growing was allowed only under certain state-legal cannabis programs.
The DEA’s letter has therefore created a state-federal disconnect. The legality of non-licensed cannabis growers or breeders selling seeds under state-legal cannabis programs is in question, sowing confusion over whether state or federal law takes precedence here and how to move forward with cannabis genetics under yet another murky regulatory environment.
